Trust Deed of 10th July 1696 Edward Kynaston to his son, Thomas To All Christian People to whom these present shall come I Edward Kynaston of the Parish of St Giles in the Field in the County of Middlesex, Gentleman send greeting Whereas Francis Molyneux Citizen and Draper of London, and Nourdigate Onsley [or Ousley?]of the Parish of St Ann Westminster in the said County of Middlesex Gentleman are bound unto me by their Bond or Obligation bearing date the day before the date of those present in the penal sums of four thousand pounds of lawful money of England with condition therein underwritten to pay to me, my Executors Administrators or Assignees the full and whole sum of two thousand and sixty pounds of like lawful money of England. All or upon the tenth day of January next ensuing the date of the same Bond (As by the said Bond and condition thereof Relation being thereunto had may appear) And whereas for a corroborating security for payment of the said two thousand and sixty pounds they the said Francis Molyneux and Nourdigate Onsley by indenture bearing even date with the said Bond and made or intentioned to be made between the said Francis Molyneux and Nourdigate Onsley of the one part and me the said Edward Kynaston of the other part (reciting as therein is receipte?) Lawsby the said indenture deposited and made over to me several tallys therein mentioned to the intent the better to service the repayment of the said two thousand and sixty pounds to me (As by the said Indenture Relation bring thereunto likewise had may appear). Now know ye that the said Bond and Indenture were made and taken in my name but In Trust for Thomas Kynaston of the Parish of St Paul Covent Garden in the said County of Middlesex Mercer (my sonne) and the moneys thereon lent were and are the proper moneys of the said Thomas Kynaston And I do by these present for me my heirs Executors and Administrators covenant promise and agree to and with the said Thomas Kynaston his Executors Administrators and Assignees that I the said Edward Kynaston have not done nor will do or cause to be done any act matter cause or thing whatsoever whereby to vacate release or discharge the said Bond and Securities (without the licence and consent of the said Thomas Kynaston his Executors Administrators and Assignees first had and obtained in writing under the hand and seal of the said Thomas Kynaston his Executors or Administrators subscribed in the presence of two or more credible witnesses for the doing thereof) And do hereby further promise and agree to and with the said Thomas Kynaston at any time or times hereafter that I my Executors or Administrators shall and will upon the reasonable request and at the proper costs and charges in the law of the said Thomas Kynaston his Executors Administrators and Assignees make do execute and perfect or cause and procure to be made done executed and perfected Any other or further act power matter and thing in the law whatsoever for the more ample declaring of the said Trust and impowering of the said Thomas Kynaston his Executors Administrators and Assignees in my name but to his and their own proper use benefit and beheste to have take receive perceive and enjoy the said moneys due and payable by the said Bond and Indenture without any attempt to be given or rendered to me for the same (the said Thomas Kynaston his Executors Administrators and Assignees from time to time saving defending and keeping in harmless? and indemnified from all costs charges and expenses whatsoever) as by the said Thomas Kynaston his Executors Administrators and Assignees or this or their Counsel learned in the Law shall be reasonably devised advised or required And I do further by these present authorize and impower the said Thomas Kynaston in my name but to his own proper use to bring any action or actions for recovery of the same moneys and generally to give any acquittance release or discharge for the same hereby ratifying and confirming whatsoever matter cause or thing the said Thomas Kynaston his Executors Administrators and Assignees shall legally do or cause to be done in about touching or concerning the same promises.
